I will demand a sports environment that is free from drugs, tobacco and alcohol and will refrain from their use at all BYG Elite Basketball sporting events. I will do my best to remember that youth sports are supposed to be FUN and that winning and losing are part of everyone's experience. I will express my concerns through the proper channels in a dignified manner. I will respect the volunteers that are assisting with the conduct of these events. I will respect and adhere to the rules governing eligibility and competition. Parents I will encourage good sportsmanship by demonstrating positive support for all players, coaches, contest administrators and officials at every game. I will place the emotional and physical well-being of the athletes ahead of my personal desire to win. Any violation of the above Code of Conduct may result in a temporary or permanent banishment from any BYG Elite Basketball activities. I, on my own behalf, and on behalf of my heirs, executors, administrators, and legal representatives (collectively the “Releasing Parties”) hereby release, and agree to defend, indemnify, and hold harmless BYG Elite Basketball, and all parties working on its behalf, and all other businesses involved with BYG Elite, as well as each of their respective employees, officers, directors, and representatives, successors and assigns (collectively the “Released Parties”), from any and all liability, actions, causes of action, suits, indirect or direct, consequential, incidental, punitive or exemplary damages, including for injury and death, against the Released Parties, which may in any way arise out of or relate to my attendance or participation in BYG Elite Sports, Inc. activities. I UNDERSTAND AND ACKNOWLEDGE THAT BY AGREEING TO THIS RELEASE AGREEMENT I AM WAIVING MY LEGAL RIGHT TO SUE BYG ELITE SPORTS, INC. AND ANY OTHER OF THE RELEASED PARTIES IN CONNECTION WITH MY ATTENDANCE AND/OR PARTICIPATION IN ANY BASKETBALL ACTIVITIES. I ALSO UNDERSTAND THAT THIS RELEASE AGREEMENT IS MADE ON BEHALF OF MY MINOR CHILD(REN) AND/OR LEGAL WARDS, AND I REPRESENT AND WARRANT TO BYG ELITE SPORTS, INC. THAT I HAVE FULL AUTHORITY TO SIGN THIS AGREEMENT ON BEHALF OF SUCH MINOR(S). SPECIAL COVID-19 NOTICE: I fully understand that (a) the coronavirus SARS-CoV-2 and any resulting disease (together with any mutation, adaptation, or variation thereof, “COVID-19”) is extremely contagious and there is an inherent risk of exposure to COVID-19 in any place where people are or have been present; (b) no precautions, including protocols that will be implemented from time to time by BYG Elite Sports can eliminate the risk of exposure to COVID-19; (c) while people of all ages and health conditions have been adversely affected by COVID-19, certain people have been identified by public health authorities as having greater risk based on age and/or underlying medical conditions; (d) other persons attending or participating in activities may not be fully vaccinated against the Covid-19 virus; and (e) exposure to COVID-19 can result in being subject to quarantine requirements, illness, disability, other short-term and long-term health effects, and/or death, regardless of age or health condition.
